1. Who is Tack Track?
1.1 Any references to “we”, “us”, “our”, “the Company” or “Tack Track” are references to 10 Rose Pty Ltd ACN 663 866 984 and its related entities as applicable.
2. What information do we collect?
2.1 Personal Information
Personal Information (or Personal Data) is information or an opinion that identifies you, or from which you can be reasonably identified, or as otherwise defined by applicable legislation. Tack Track collects and stores Personal Information which may include:
- your name;
- your email address;
- your mobile number;
- your address, including shipping address;
- your log-in details and password;
- your browsing history;
- your payment details such as credit card information;
- details of your tack equipment including images you share with us;
- any information you voluntarily share with us when you interact with us via phone, email, social media or other forms of communication;
- any other information provided voluntarily by you as part of your membership or subscription;
- your response to surveys, competitions and promotions;
- your marketing preferences such as whether you’d like to receive communications from us; and/or
- information automatically collected when you visit our Website, for example what type of device and browser you are using, as well as your location.
2.2 In order to verify your ownership of the horse-riding and equestrian equipment which you upload to the Website or access the Service in respect of, our identify verification service provider may collect information from you in order to verify your identity, including your drivers’ licence number, passport number and/or date of birth. This information is not collected or stored by Tack Track and will be managed by the third party in accordance with its own privacy policy. We encourage you to review the third party privacy policy before disclosing any personal information. We take no responsibility for any personal information disclosed to third parties.
2.3 Children
We are committed to protecting the privacy of children. The Website and the Service are not directed at children aged under 16. Tack Track will therefore not intentionally collect information about any user under the age of 16. If a child under the age of 16 wishes to use the Website or Service, consent must be given by a parent or legal guardian, and this must be under the supervision of a parent or legal guardian.

- become a member of, or undertake a trial of, the Website or the Service;
- otherwise engage with the Service;
- visit our Website;
- create an account with us;
- sign up to receive our tips, offers and marketing emails;
- make a purchase, including membership, or any other goods or services on our Website;
- contact us via phone, email, letter, social media or any other forum;
- enter a competition or promotion; and

5.1 We want to give you the best experience possible when interacting with us and using the Service. We collect information primarily to allow you to use our Website as well as to enjoy the benefits of the Tack Track Service that accompany your subscription, membership, or trial with us.

- to allow you to become a member and to facilitate your membership or a trial of our Service;
- to properly identify, verify and communicate ownership of equipment that is registered on the Website;
- to provide you with goods or services you have purchased and to allow you to advertise goods for sale;

- to contact you to participate in competitions, promotions or surveys;
- to inform our marketing and business strategy;
- to promote our business;

5.4 What happens if we are unable to collect your Personal Information?
If we are unable to collect your Personal Information, we may not be able to fulfil our obligations to you including providing the Service. We may not be able to provide you with goods and services, or answer enquiries about your membership or the goods and services we provide. Your experience when interacting with us may be delayed or not as efficient as we would like. We also will be unable to keep you informed of the latest updates, promotions, rewards, competitions and marketing messages.
5.5 We will provide you with the opportunity of remaining anonymous or using a pseudonym in your dealings with us where it is lawful and practicable. Generally, it is not practicable or lawful for us to deal with individuals anonymously or pseudonymously.

7. Do we disclose your information overseas?
7.1 Tack Track is based in Australia. As a result, the majority of our service providers are also based in Australia. However, we may, from time to time, disclose your information to our third party services providers that may store data overseas.
7.2 Examples of when your Personal Information may be shared overseas include:
- for storage purposes. Our main data storage systems are based in Australia; however, we may from time to time also store data in servers based in the United States of America and throughout Europe
- in order for our third-party service providers who assist us with our business to undertake required work. For example, our third party payment processing service provider operates out of San Francisco in the United States of America.
7.3 We only ever disclose your Personal Information outside the jurisdiction where it was collected where we are permitted to do so under applicable laws. This means we have taken necessary steps to keep your information safe, and to protect it against misuse, interference, or loss, and from unauthorised access, modification, or disclosure.

8.1 We take every effort to store your Personal Information safely and protect it against misuse, interference or loss, and from unauthorised access, modification and disclosure. We may hold your Personal Information either in electronic or hard copy form.

We take every effort to keep your information safe in accordance with relevant government regulation and requirements. Our servers, computer systems and internet hosting are protected through security systems including physical locks, firewalls, security systems, regular back-ups of retained data, and are encrypted with passwords both in rest and in transit.

10.3 We take reasonable steps to ensure that the Personal Information we collect, use and disclose is accurate, complete and up-to-date. However, because the accuracy of the information we store is dependent on the information you provide, we encourage you to regularly review and update your Personal Information. If your Personal Information requires updating, or there are any errors in your Personal Information:

11. Privacy Complaints

All such enquiries or complaints will be taken seriously and handled with impartiality and discretion. If you wish to submit a complaint, please provide us with all relevant details such as the date and time of the incident or communication, the circumstances surrounding the event, and your concerns about what was said or done.
